By accessing our Site or utilizing our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Site and our services immediately.
1. Business Relationship and Entity Disclosure
Java Travel USA LLC is owned and operated by Eva Kingsley. Eva Kingsley operates as an Independent Contractor of Archer Travel Inc. (FL #35395 • CST #2001330-10 • Hawaii #TAR-6612 • WA #603352551). By booking through Java Travel USA LLC, you acknowledge that we act as an intermediary between you and various third-party travel suppliers and act solely as a booking agent; all third-party service providers (including resorts, airlines, cruise lines, tour operators, transportation providers, and dive shops/operators) are independent entities and are not owned, operated, or controlled by Java Travel USA LLC.
2. Scope of Services
Java Travel USA LLC provides customized travel planning and concierge services, including but not limited to:
- Customized international and domestic itineraries;
- Booking of cruises, theme parks, resorts, flights, and expeditions;
- Specialized scuba diving travel arrangements for individuals (FIT) and groups;
- Professional travel consultation and support.
3. Specialized Scuba Diving Travel
Java Travel USA LLC specializes in scuba diving expeditions. While we partner with reputable third-party dive operators and other travel suppliers, you acknowledge that:
- Scuba diving and other expedition-style activities are inherently risky.
- Travelers are responsible for maintaining valid dive certifications and ensuring they are medically fit to participate.
- Java Travel USA LLC is not responsible for accidents occurring during these activities.
- Java Travel USA LLC is not responsible for the safety protocols, equipment maintenance, or dive mastery of third-party dive operators.
- Proof of dive insurance (e.g., DAN) is highly recommended for all dive-related bookings.
4. Third-Party Vendors and Liability
Java Travel USA LLC acts solely as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”).
- Supplier Terms: All bookings are subject to the specific terms, conditions, and cancellation policies of the respective Suppliers.
- Limitation of Liability: SERVICES (INCLUDING THE SITE, CONTENT, AND ANY TRAVEL PLANNING, BOOKING, OR CONCIERGE SERVICES) ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAVA TRAVEL USA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. JAVA TRAVEL USA LLC IS NOT LIABLE FOR ANY NEGLIGENT OR WILLFUL ACT OR FAILURE TO ACT OF ANY SUPPLIER OR ANY OTHER THIRD PARTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JAVA TRAVEL USA LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, YOUR BOOKINGS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. We are not responsible for any injury, loss, death, damage, delay, or inconvenience caused by a Supplier’s failure to provide services, financial insolvency, or force majeure events (including weather, strikes, or government actions).
5. Blog and Affiliate Disclosure
The Site contains blog posts, travel tips, and itineraries. Some links on this Site are “affiliate links.” This means if you click on the link and purchase an item or book a service, Java Travel USA LLC may receive an affiliate commission at no extra cost to you. We only recommend products or services we believe will add value to our clients and readers.
6. Payments and Fees
We facilitate bookings between you and various travel vendors (airlines, resorts, cruise lines, etc.). Payments may be accepted and/or processed through third-party platforms including Square, Stripe, Venmo, Zelle, CashApp, and WeTravel, as well as through a Supplier’s proprietary payment portal or direct vendor processing. By booking, you agree to the specific terms, conditions, and cancellation policies of the third-party vendors and/or payment platforms used.
- Payment Platform Disclaimer: Java Travel USA LLC is not responsible for errors, delays, failed transactions, chargeback handling, or any security breach, outage, or interruption occurring on or involving any third-party payment platform (including Square, Stripe, Venmo, Zelle, CashApp, and WeTravel) or any Supplier payment portal. Any payment disputes, reversals, or chargebacks must be handled in accordance with the applicable payment platform’s and/or Supplier’s terms and procedures.
- Service Fees: Java Travel USA LLC reserves the right to charge non-refundable planning or concierge fees. These fees will be disclosed to you prior to the commencement of services.
- Pricing: Prices are subject to change by the Supplier until a booking is confirmed and paid in full.
7. Travel Documentation and Insurance
It is the sole responsibility of the traveler to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations.
Travel Insurance: We strongly recommend the purchase of comprehensive travel insurance. Java Travel USA LLC is not responsible for costs incurred due to trip cancellations, medical emergencies, or lost luggage.
8. Intellectual Property
All content on this Site, including text, graphics, logos, and itineraries, is the property of Java Travel USA LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works from this content without express written permission.
9. User Conduct
You agree to use the Site for lawful purposes only. You are prohibited from using the Site to post or transmit any material that is defamatory, offensive, or infringing on the rights of others.
10. Governing Law
These Terms and any disputes arising out of your use of the Site or our services shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within the State of Louisiana for the resolution of any disputes.
11. Changes to Terms
