Welcome to Java Travel USA LLC. We are thrilled to help you plan your next underwater adventure. Because scuba diving involves inherent risks, we have established these Health & Safety Guidelines to ensure you are prepared for your trip and understand the relationship between Java Travel USA LLC, our partner vendors, and you as the diver.
1. Agency Role and Scope of Service (Booking Agent Only)
Java Travel USA LLC acts strictly as a travel intermediary and concierge service. We facilitate bookings with third-party service providers, including dive shops, resorts, and charter vessels (the “Service Providers”).
Please be advised:
- Java Travel USA LLC is a booking agent only and is not the provider of scuba instruction, guiding, vessel operations, equipment servicing, or any diving activity.
- Java Travel USA LLC is not a dive shop, training agency, or equipment manufacturer.
- We do not employ dive instructors or divemasters, nor do we provide direct supervision of diving activities.
- The actual diving services are governed by the specific terms, safety protocols, medical screening requirements, and liability waivers of the Service Provider at your destination.
2. Mandatory Compliance with Service Providers (Rules + Medical Requirements)
While Java Travel USA LLC coordinates your itinerary, your safety on the water is managed by the local Service Provider.
- Adherence to Rules: You must comply with all safety briefings, vessel regulations, and diving protocols established by the dive shop or operator (e.g., Salty Endeavors or other global partners).
- Medical Requirements and Screening: You are responsible for meeting any medical prerequisites required by the Service Provider and/or training agency standards used by that provider (including completion of medical questionnaires, physician clearance, or “Fit to Dive” documentation when requested). If you do not meet the Service Provider’s medical requirements, you may be refused participation, and refunds (if any) will be subject to the Service Provider’s policies.
- Authority of the Divemaster: The local Divemaster or Captain has the final authority to cancel or modify dives based on weather conditions, diver proficiency, or safety concerns.
- Documentation: You will be required to sign separate liability waivers, assumption-of-risk forms, and medical questionnaires provided by the local Service Provider upon arrival. Failure or refusal to complete these documents truthfully and in full may result in a denial of service without a refund.
3. Diver Prerequisites and Certification (Required)
By booking a scuba diving itinerary through Java Travel USA LLC, you represent and warrant that:
- Valid Scuba Certification Required: You hold a current, valid scuba certification from a recognized agency (e.g., PADI, NAUI, SSI) that is appropriate for the level of diving booked (including any specialty or advanced requirements for deep, wreck, cavern/cave, nitrox, drift, night, or other conditions). You must carry your certification card (C-Card) and any required proof of specialty training, and you are responsible for providing certification details to the Service Provider upon request.
- No Certification / Mismatch of Certification: If you cannot present required certification (or do not meet the minimum training level for the dives offered), the Service Provider may deny participation without a refund, subject to the Service Provider’s policies.
- Experience Levels: You are responsible for ensuring your skill level is appropriate for the chosen destination and conditions (e.g., drift diving, deep diving, or night diving).
- Refresher Courses: If you have not dived within the last six to twelve months, we strongly recommend completing a scuba review or “refresher” course prior to your trip (or booking a guided refresher at the destination, if available).
4. Health and Medical Fitness (Physical Fitness + Health Disclosure)
Scuba diving is a physically demanding activity.
- Medical Evaluation: We recommend that all clients undergo a medical evaluation by a physician before participating in scuba diving, particularly if there is a history of respiratory, circulatory, or neurological conditions.
- Fitness and Ability: You are responsible for ensuring you are physically fit for diving, including the ability to manage ocean conditions, currents, boat entries/exits, ladders, and carrying/handling equipment.
- Truthful Health Disclosure: You agree to accurately and completely disclose relevant health information on any medical forms, questionnaires, or screening tools required by the Service Provider. You also agree to promptly notify the Service Provider of any change in your health status (including illness, injury, pregnancy, new medications, or recent surgery) that occurs before or during the trip.
- Physician Clearance When Indicated: You must be in good physical health. If you have a pre-existing condition that may be contraindicative to diving, you must obtain a medical “Fit to Dive” clearance from a physician, and you are responsible for providing that clearance in the format/timeframe required by the Service Provider.
- Alcohol and Substances: The consumption of alcohol or mind-altering substances before diving is strictly prohibited and may result in cancellation of your dive day by the Service Provider without a refund, subject to the Service Provider’s policies.
5. Dive Insurance (Client Required)
Given the high cost of specialized medical care and emergency evacuations associated with diving accidents, Java Travel USA LLC requires that all clients carry their own active dive-specific accident insurance.
- Recommended Provider: We suggest Divers Alert Network (DAN) or an equivalent provider that covers hyperbaric chamber treatments, physician/hospital expenses related to dive injuries, and emergency medical evacuation.
- You Are Responsible for Coverage: You are solely responsible for selecting, purchasing, and maintaining appropriate coverage, understanding policy terms, exclusions, and claim procedures, and carrying proof of coverage if requested by a Service Provider.
- No Coverage / Insufficient Coverage: If you choose not to carry dive-specific accident insurance, you accept full financial responsibility for any medical treatment, emergency transport, evacuation, chamber treatment, and related costs, and you acknowledge that Java Travel USA LLC does not provide, sponsor, or pay for such coverage.
- Travel Insurance: We also recommend comprehensive travel insurance to cover trip cancellations or interruptions due to weather or health issues.
6. Safety Best Practices (Standard Safety Protocols)
For your protection, we encourage all clients to follow standard safe diving practices, including:
- Follow Briefings + Local Conditions: Attend and follow all dive briefings and respect site-specific hazards, local laws, and operator procedures.
- The Buddy System: Never dive alone. Stay within an appropriate distance of your buddy and the group, and communicate clearly using standard hand signals.
- Depth/Time Limits: Dive within your training limits, comfort level, and the plan set by the Divemaster/Captain (including maximum depth, turn pressure, and time limits).
- Equipment Checks: Conduct pre-dive safety checks (BWRAF or equivalent). If using personal gear, ensure it has been serviced within the last year and is appropriate for the environment.
- Decompression Safety: Always follow your dive computer or tables, monitor gas consumption, ascend slowly, and perform safety stops as recommended. Allow for conservative surface intervals.
- Flying After Diving (No-Fly Times): Adhere to standard “No Fly” guidance (generally a minimum of 12 hours after a single no-decompression dive, 18 hours after multiple dives/multiple days of diving, and longer after decompression dives), and follow the more conservative requirement if your computer, training agency, or Service Provider recommends it.
- Emergency Preparedness: Inform the Service Provider immediately if you feel unwell before or after a dive (including symptoms consistent with decompression illness).
7. Limitation of Liability
Java Travel USA LLC, its owners, and employees (including Eva Kingsley) shall not be held liable for any injury, loss, death, or damage to person or property arising out of, relating to, or occurring during scuba diving activities booked through our agency, including (without limitation) any acts or omissions of any Service Provider, divemaster, instructor, captain, crew member, equipment provider, or other third party. You acknowledge and agree that scuba diving is an inherently hazardous activity and that any injury, accident, illness, loss, or death may occur regardless of precautions. By proceeding with a booking, you acknowledge that you are aware of the risks of scuba diving—including but not limited to decompression sickness, drowning, equipment failure, boat-related incidents, and marine life encounters—and you choose to participate voluntarily. You further acknowledge that you are responsible for carrying your own specialized dive accident insurance as described in Section 5.
